General Terms and Conditions

§ 1 Scope

1. These General Terms and Conditions (GTC) apply to all consultations, treatments, online sessions and additional services provided by the Practice for Traditional European Naturopathy, Maureen Liebschner, Dipl. Naturopathic Practitioner TEN, Neptunstrasse 63, 8032 Zurich (hereinafter the “Practice”).

2. They apply to patients (hereinafter the “Patient”) from the first appointment booking onwards and to all subsequent appointments.

3. The version in force at the time of booking shall apply and is available at www.maureen-liebschner.com. Amendments are published on the website and apply to appointments booked thereafter.

4. Deviating agreements are valid only if confirmed in writing (including by email).

5. The Practice provides treatment in its own premises at Neptunstrasse 63, 8032 Zurich, and at other locations such as health centres. At these locations, too, Maureen Liebschner acts as a self-employed therapist in her own name and for her own account. She is neither an employee nor a representative of the Partner Location.

6. At Partner Locations, too, the treatment contract is concluded exclusively between the Patient and the Practice. The Practice sets its own appointments, working hours, treatment methods and fees, issues its own invoices and keeps the patient file. The Partner Location merely provides premises and infrastructure against payment, has no access to patient data and is not liable for the Practice's services.

§ 2 Treatment Contract and Services

1. The treatment contract (simple mandate pursuant to Art. 394 et seq. of the Swiss Code of Obligations, CO) is concluded upon confirmation of the appointment, and at the latest when the first consultation begins. The non-binding introductory meeting does not constitute a treatment contract.

2. The Practice offers methods of Traditional European Naturopathy (TEN), in particular iridology, dark-field microscopy, cupping, leech therapy, Dorn therapy, phytotherapy, massage and energy work. The type and scope of treatment are agreed individually.

3. The Practice provides treatment with due care and to the best of its knowledge in accordance with the principles of the OdA AM and the EMR. The Practice owes professional treatment, not a specific treatment outcome. No promise of cure is given.

4. The Practice may decline or discontinue treatment without stating reasons, in particular if there is no relationship of trust or if the complaints require medical assessment. Services rendered up to that point remain chargeable.

5. Either party may terminate the contract at any time (Art. 404 CO). Agreed appointments remain in place until cancelled in due time in accordance with § 3.

6. Online and telephone consultations require a stable connection on the Patient’s side. Connection problems on the Patient’s side do not extend the session.

§ 3 Appointments, Cancellations and Cancellation Fee

1. Appointments are made online, by telephone (+41 76 229 11 99) or by email and become binding upon confirmation. The appointment time is reserved for the Patient.

2. Appointments may be cancelled or rescheduled free of charge up to 24 hours in advance by email, text message or voicemail.

3. In the event of later cancellation or non-attendance, a cancellation fee of CHF 100.– will be charged. This fee is not a treatment service and is not reimbursed by supplementary insurance.

4. For leech therapy, the cancellation period is 72 hours, as the leeches are ordered specifically. In the event of later cancellation, material costs will also be charged.

5. The cancellation fee does not apply if the Practice is able to reallocate the appointment or if the Patient provides evidence of an unforeseeable impediment (e.g. medical certificate, accident).

6. If the Patient arrives late, the treatment time is shortened accordingly; the reserved time will be charged.

7. The Practice may cancel appointments for good cause (e.g. illness) and will inform the Patient as early as possible. There is no entitlement to reimbursement of travel or other costs.

§ 4 Fees and Health Insurance

1. Fees are charged according to time spent in accordance with Tariff 590, in 5-minute increments: CHF 12.25 per 5 minutes (CHF 147.– per hour). The current price list is published on the website.

2. Guide prices: initial anamnesis (90 min) CHF 220.50; treatment (60 min) CHF 147.–; individual analyses and treatment plans CHF 147.–.

3. Additional services are charged according to time spent, in particular prescriptions, telephone, email and online consultations, evaluation of laboratory results, reports and insurers’ health questionnaires. Materials, remedies, leeches and laboratory costs are charged separately.

4. The Practice is registered with the EMR under ZSR no. W090563. Complementary medicine services are not covered by compulsory basic health insurance (KVG). Reimbursement is possible only through supplementary insurance (VVG).

5. Before treatment begins, the Patient is responsible for clarifying whether and to what extent their supplementary insurance covers the costs. Obtaining a written confirmation of cost coverage is recommended.

6. The fee is payable in full regardless of any reimbursement by the insurer.

7. Price changes are announced on the website at least 30 days in advance and apply to services rendered thereafter.

8. Gift vouchers are valid for 24 months from the date of issue, cannot be exchanged for cash and cannot be claimed from supplementary insurance.

§ 5 Terms of Payment

1. Fees are due after each treatment and are payable in cash, via TWINT or by card. For payment by invoice, the payment term is 20 days from the invoice date.

2. The invoice, including the reimbursement form in accordance with Tariff 590, is sent by email. By providing their email address, the Patient consents to electronic delivery. Delivery by post is available on request for CHF 3.–.

3. Once the payment term has expired, a payment reminder is sent free of charge. The first formal reminder costs CHF 20.– and the second CHF 30.–, each payable within 10 days.

4. From the date of default, the Patient owes default interest of 5% (Art. 104 CO). If the second reminder remains unpaid, the claim may be transferred to a debt collection agency or debt enforcement proceedings may be initiated. The costs are borne by the Patient.

5. Awaiting reimbursement from the insurer does not defer the due date.

6. If invoices remain unpaid, the Practice may make further appointments subject to advance payment.

§ 6 Information and Patient Cooperation

1. Naturopathic treatments complement conventional medicine and do not replace medical diagnosis, assessment or treatment. The Practice does not make medical diagnoses and does not provide emergency care. In an emergency, call 144.

2. The Patient shall inform the Practice fully and truthfully about complaints, previous illnesses, diagnoses, ongoing therapies, medication, allergies, blood clotting disorders and any pregnancy. The Patient shall report any changes without delay.

3. The Patient shall not discontinue medication or therapies prescribed by a doctor without first consulting the treating doctor.

4. Before invasive procedures (e.g. wet cupping, leech therapy, capillary blood sampling for dark-field microscopy), the Practice explains the procedure, risks and alternatives. Once this information has been provided, the Patient’s verbal agreement constitutes consent. The Practice records the information provided and the consent in the patient file.

5. For minors, the consent of the legal representative is required unless the minor has capacity of judgement.

§ 7 Professional Confidentiality, Data Protection and Records

1. The Practice is subject to professional confidentiality under Art. 62 of the Swiss Federal Act on Data Protection (FADP). Health data is sensitive personal data (Art. 5(c) FADP) and is processed in strict confidence (FDPIC).

2. Data is processed only for treatment, invoicing and compliance with legal obligations. Data is disclosed to third parties (e.g. doctors, laboratories, insurers) only with the Patient’s consent or where required by law.

3. The Patient consents to the Practice using the software iTherapeut by Softrey, with data storage in Switzerland and Germany, for appointment management, invoicing and patient records. Laboratory samples are sent to a suitable specialist laboratory after discussion with the Patient.

4. Communication by unencrypted email, text message or messenger involves risks (interception, misdirected messages). By using these channels, the Patient accepts these risks. Encrypted communication is available on request.

5. The Practice keeps a patient file and retains it for at least 20 years after the end of treatment. The Patient has the right to access their file and to receive a copy of it.

§ 8 Liability

1. The Practice is liable for damage arising from treatment in accordance with the statutory provisions. Liability for slight negligence is excluded to the extent permitted by law. Liability for intent and gross negligence remains unaffected (Art. 100 CO).

2. The Practice is not liable for damage resulting from the Patient providing incomplete or incorrect information under § 6 or failing to follow recommendations.

3. The Practice holds its own professional liability insurance with Zurich Insurance and its own accident insurance with Swica.

4. No liability is accepted for clothing or valuables left in the practice premises.

§ 9 Final Provisions

1. These GTC are governed exclusively by Swiss law.

2. The place of performance is Zurich. The place of jurisdiction is Zurich, unless the law prescribes a mandatory place of jurisdiction (in particular Art. 32 and 35 of the Swiss Civil Procedure Code, CPC, for consumer contracts).

3. Should any provision be invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by a permissible provision that comes closest to its purpose.

4. By booking an appointment, the Patient confirms having read and accepted these GTC. Acknowledgement is confirmed at the first consultation.

5. These GTC are a translation of the German original. In the event of any discrepancy, the German version shall prevail.
